If there has ever been a time to get your ducks in a row within your business, the time is now. Gone are the days when you waited for the (unlikely) day of a disgruntled current or former employee “dobbing you in” to the authorities for breaching your obligations under one of the many workplace or taxation laws.
The Australian Taxation Office and the Fair Work Ombudsman are both currently providing whistleblower services which allow individuals to anonymously report contraventions of taxation and workplace legislation straight to the authorities for investigation.
The ATO’s “dob in” ” service allows employees to report incidents of their employers paying them illegally through “cash in hand” payments, as well as failures to pay superannuation, providing incorrect payment summaries, and incorrectly classifying employees as independent contractors, all of which carry heavy penalties if substantiated.
In 2015 -2016 the ATO monitored a total of 127,000 cash economy businesses, and after conducting 15,000 audits and enforcement activities, raised over $208 million in tax and penalties.
In a similar service launched in May this year, the Fair Work Ombudsman is offering their own anonymous tip off service, allowing employees, consumers, concerned citizens and even competitors to dob in businesses that rip off their staff.
In a speech given in May this year, Natalie James, the Fair Work Ombudsman put out a plea to not only workers, but members of the public saying;
“Compliance with workplace laws isn’t just my business, it’s everyone’s business – when workers get ripped off, and everyone is affected. If you suspect a business is exploiting its workers, or if something doesn’t seem right, we want you to tell us.”
